1. Registration and Access
a. Registration Required: Access to and use of the Services are restricted to individuals who are registered and authorized by the Customer as users of the Services ("Registered Users"). Each user must have a unique user identifier that cannot be shared with or used by any other individual.
b. Unauthorized Use: The Customer agrees to monitor the use of the Services to prevent access by non-registered individuals. The Customer will immediately deactivate the access of any individual who ceases to be a Registered User or who is not authorized to use the Services.
c. Responsibility for Use: The Customer is responsible for all activities that occur under the accounts of Registered Users and agrees to notify the Provider promptly of any unauthorized access or use. Failure to comply with these registration and access requirements constitutes a breach of this Agreement and may result in termination of the Agreement and legal action against the Customer.
d. Security Measures: The Customer shall implement reasonable security measures to ensure that only Registered Users access and use the Services, including but not limited to secure management of passwords and access controls.
2. Disclaimer of Liability for Costing and Data Accuracy
a. No Liability for Cost Estimates: The Customer acknowledges that any cost estimations, financial projections, or pricing information generated by the Services are for informational purposes only and are based on the data inputs provided by the Customer. The Provider makes no guarantees regarding the accuracy, completeness, or applicability of such estimations, and the Customer assumes full responsibility for any decisions made based on these outputs.
b. Data Accuracy and Misrepresentation: The Provider is not liable for any errors, inaccuracies, or misrepresentations in the data provided by the Customer or any third party. The Customer is solely responsible for verifying the accuracy and reliability of any data used within the Services and acknowledges that reliance on any output generated by the Services is at its own risk.
c. Limitation of Liability: Under no circumstances shall the Provider be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to financial losses, business disruptions, or reputational harm, arising from the use of the Services, reliance on generated data, or inaccuracies in cost calculations.
